Wright CONSERVE PLUS Total Hip System

Metal Hip Replacement Recall, Defective Metal Hip

The Wright Conserve Plus Total Hip Replacement System is a metal-on-metal artificial hip implant manufactured by Wright Medical Technologies, Inc. This type of system is used when a patient’s hip joints become damaged through injury or disease.

The U.S. Food and Drug Administration has received numerous adverse event reports from patients who say they were seriously injured by a Wright Conserve hip system. In many cases, the patients required painful revision surgery to correct the problems associated with the implant’s failure.

» What Are the Problems With the Conserve Plus Hip Implants?

We believe the primary issue associated with the Wright Conserve Plus hip is its design, which fits very similar to the now-recalled DePuy ASR hip implant. Metal-on-metal hip implants, including the Conserve hip, feature a metal femoral head that fits into a metal acetabular cup. These components are made of cobalt and chromium, which grind against one another when the joint is in motion. This contact can cause:

  • Excessive heat and friction, which can wear the metal components down more quickly
  • Shedding of tiny bits of metal particles into the hip joint and surrounding body tissue
  • An increased level of metal ions in the body, which can lead to metal poisoning. Metal poisoning, in turn, can result in tissue necrosis, heart problems and other adverse health effects.

Unlike the DePuy ASR hip, there has been no recall of the Conserve hip implants. This means that more patients are potentially at risk for being injured by one of these devices.

We are investigating Wright cases that resulted in the need for corrective surgery. We are available to represent injured hip implant recipients in all 50 states.

» Has the Wright Conserve Plus Hip system been recalled?

To date, no official recall has been issued for the Conserve Plus hip replacement system. A number of medical professionals are, however, urging the U.S. Food and Drug Administration to consider a recall based on mounting evidence which suggests that these devices are failing at a much faster rate than originally predicted.

Despite the fact that no recall of these devices has been issued, hip implant patients have continued to filed lawsuits against the device’s manufacturer, Wright Medical Technologies, Inc. The plaintiffs claim that the Conserve cup caused serious complications, including:

  • Pain
  • Swelling
  • Tenderness
  • Decreased mobility
  • Reduced quality of life
  • Metal poisoning
  • A need for additional corrective surgery

In December 2011, a number of plaintiffs filed a motion with the U.S. Panel on Multidistrict Litigation to have the Wright Conserve cases consolidated into a single case for pretrial proceedings. If you believe that you may have grounds for a personal injury claim stemming from a defective metal hip implant, you may want to consider joining the other individuals that have already filed suit.

» Why did the FDA approve the Wright Conserver hip system if the were defective?

The Wright Conserve Plus Total hip , like many other metal-on-metal hip replacement systems, was approved under the U.S. Food and Drug Administration's 510(k). Under the 510(k) guidelines, medical device manufacturers only have to prove that a similar device has already been approved and made available on the market.

While the 510(k) system is meant to streamline the approval process, critics say it allows defective and faulty devices to reach the market where they are sold to unsuspecting consumers. Medical and legal professionals point to the now-recalled DePuy ASR hip system which was approved under the 510(k) rule.

In May 2011, the FDA asked metal hip manufacturers to provide more information about the rate at which the metal components in the artificial hips shed debris into the body and the potential side effects caused by the release of metal particles into the body.

In December 2011, the U.S. Senate introduced new legislation which would allow for increased tracking and monitoring of metal hips and other medical devices that go through the fast-track approval process. It remains unclear, however, whether the FDA will make any significant changes to how artificial hips and other medical devices gain approval.

If you or a loved one received a Wright Conserve Plus hip implant and experienced any of the following side effects, you need to contact a qualified personal injury lawyer to protect your rights.

  • Ongoing pain
  • Swelling
  • Limited mobility
  • Increased medical bills
  • The need for additional surgery
  • Loss of quality of life

December 19, 2011 News Alert – Wright Conserve plaintiff seeks consolidation of cases in Georgia

One of the plaintiffs who filed a personal injury lawsuit against Wright Medical Technologies Inc. over a faulty hip implant is asking a federal judge to consolidate the cases for pretrial proceedings. If the U.S. Panel on Multidistrict Litigation grants the motion, the cases will be heading to trial in the Northern or Southern District Court of Georgia.

Plaintiff Danny James claims that consolidating the cases will help to streamline the trial process and reduced costs for all parties involved. James, along with a number of other plaintiffs, filed suit after sustaining injuries caused by the Wright Conserve hip replacement system. The plaintiffs say the hip implants, which use a metal-on-metal structure, have caused serious pain, tissue damage and in some cases, metallosis caused by the metal components rubbing together. All of the litigants involved are seeking an unspecified amount of damages for their pain and suffering, medical bills and lost wages.

The lawsuits filed against Wright Medical Technologies mirror those filed against Johnson & Johnson’s DePuy Orthopedics. In 2010, the FDA ordered a recall of DePuy’s ASR hip replacement systems. Since the recall was issued, numerous plaintiffs have filed suit alleging serious injury caused by these defective devices. Claims have also been filed against Zimmer and Biomet, alleging injuries caused by defective hip replacement systems.

The U.S. Senate recently proposed a new piece of legislation which would allow for increased safety monitoring of hip implants and other medical devices. If passed, the bill would grant the FDA administrative power to require hip implant manufacturers to conduct ongoing safety reviews of their products after they hit the market.

It remains unclear whether the plaintiff's motion for consolidation will be granted in the Wright Conserve cases. With new lawsuits being filed every day, consolidation may make sense if the total number of cases becomes unmanageable.

Consumer advocacy groups are urging individuals who received a Wright Conserve, DePuy ASR, DePuy Pinnacle, Biomet or Duron metal-on-metal hip implant to speak with an experienced personal injury attorney regarding their claim. National law firm Nadrich & Cohen LLP is now offering free initial case evaluations to hip implant recipients who may have sustained serious injuries after receiving one of these devices.
