Hip Replacement Lawsuit in Los Angeles


According to court documents, over 3,000 DePuy Pinnacle hip lawsuits and 10,000 DePuy ASR claims have been filed against DePuy Orthopaedics and Johnson & Johnson, alleging that their metal-on-metal hip implant devices were defectively designed and caused patients to suffer from adverse and life-threatening complications. Patients Allege Complications

Johnson & Johnson issued a voluntary recall of over 93,000 DePuy ASR implants in August 2010 after data concluded that the devices were demonstrating unacceptably high failure rates. The company estimates that, while the implants were designed to last between 15 to 20 years, roughly 40 percent of the devices were failing within the first five years.

Those who have already filed claims and patients who may be considering filing a hip replacement lawsuit in Los Angeles allege that the metal components of the implants may potentially rub together and cause an accumulation of metal shards in the bloodstream. Lawsuits also claim that both DePuy and Johnson & Johnson were aware of the dangers of the devices and failed to warn physicians and patients. Victims of the recalled devices allege that they have suffered from complications, including:

  • Fractures
  • Infection
  • Degeneration of bone tissue
  • Instability
  • Noises, clicks and pops from the implant
  • Formation of pseudotumors

However, in November 2013, DePuy announced a settlement that would resolve roughly 8,000 of the 12,000 claims currently pending against the manufacturer. The settlement program is limited to patients who received the ASR hip implant and who underwent revision procedures no later than August 31, 2013. According to court records, plaintiffs will be entitled to a base award of $250,000. Still, those who are not eligible to take part in the settlement may still be entitled to recover damages for their injuries.
